Bitcoin's rebound
Bitcoin spent Tuesday night below $76,000 — a seven-week low — as traders braced for what a Democratic Congress would mean for crypto. By Wednesday afternoon, it was back above $80,800, up 4% on the day.
The simplest read, Warner wrote, is that uncertainty lifted and crypto exhaled — and that could be part of it. But oil helped too: WTI crude fell 9% to $88 a barrel, down almost 17% on the week, after Iran's parliament speaker said voters had "said NO TO WAR." The Dow jumped 3% on the day and the Nasdaq added 1.6%, capping a broadly green session across markets.
James Butterfill of CoinShares put it plainly: "For Bitcoin, real yields, dollar liquidity and ETP flows still carry more weight than the elections."
Democrats revive market structure push
The policy news that landed Wednesday afternoon, Warner argued, mattered more than the price action. Journalist Eleanor Terrett reported, citing three industry sources, that House Democrats are discussing expanding Maxine Waters' Crypto Investor and Consumer Bill of Rights — originally an amendment to the CLARITY Act in 2025 — into a full market structure bill in the next Congress.
Market structure legislation is designed to settle which federal regulator writes the rules for digital asset trading — the jurisdictional question the draft's proposed SEC-CFTC split would redraw.
According to the report, the draft would fold in Democratic CLARITY provisions the House rejected last year, plus provisions Senate Democrats and Republicans had already agreed on before the September cloture vote that killed the bill.
The talks came as a genuine surprise. Only twenty-four hours earlier, the consensus was that market structure legislation was dead for two years. Waters, the likely incoming chair of the House Financial Services Committee, is apparently planning to write a bill rather than hold hearings.
The legislation would carry changes. The proposals under discussion would give the SEC a larger role supervising crypto markets and leave the CFTC with a smaller one. The draft is also expected to include ethics provisions restricting the crypto activities of Trump and other federal officials — long-standing Democratic demands that many believed would kill any chance of the bill being signed.
Warner characterized the effort as one of the first courses of action from the Democrat-led Congress: enacting changes to the CLARITY Act in an attempt to get it passed in 2027, a move he called "a very bullish first step," adding, "Let the post-Trump crypto era begin…"
With the next Congress set to convene in January, what to watch first is whether formal draft text emerges — and whether it holds onto the bipartisan Senate provisions that survived the last attempt.
Macro crypto and markets
- Crypto majors were green after the post-midterms rally: BTC +2% at $79,900; ETH +3% at $2,390; SOL +2% at $95; HYPE -5% at $81.80; ZEC flat at $1,298
- INJ (+8%), ATOM (+7%) and RAY (+6%) led the top altcoin movers
- Oil -8% at $88; gold +1.5% at $4,135
- Stock futures were mixed after the rally: Dow +0.5%, Nasdaq -0.7%
Coinbase details custody practices
Coinbase said in a blog post responding to the Binance hack that it holds more than 99% of customer assets in cold storage, according to Decrypt's report. The post detailed split cold-wallet keys that are never fully reassembled, rate limits on cold-to-hot transfers, and kill switches that take signing keys offline entirely.
Cold storage keeps the private keys controlling customer wallets on offline systems, beyond the reach of remote attackers — the safeguard the industry treats as its first line of defense when custody practices come under scrutiny.
ZachXBT raises theft estimate to $133 million
On-chain investigator ZachXBT named French banking group Crédit Mutuel Arkéa as the alleged victim of a crypto theft now exceeding $133 million, up from the $106 million he flagged on Monday, as Decrypt reported.
Morgan Stanley moves securities onchain
Morgan Stanley converted U.S. equities and Treasuries into tokenized form through the DTCC Tokenization Service, which launched October 28 on the Canton Network and DTCC's private Besu chain (Decrypt).
The DTCC operates the post-trade infrastructure that clears and settles U.S. securities trades, meaning the service brings blockchain records into the core of Wall Street's settlement plumbing rather than around its edges.
Binance and Deribit cut off SignalPlus
Binance and Deribit revoked all API keys linked to third-party trading platform SignalPlus after SignalPlus flagged a potential security issue (Decrypt).
Corporate treasuries and ETFs
The Bitcoin ETFs saw $74 million in net inflows on Wednesday, while the ETH ETFs took in $53 million, flipping to inflows and breaking their outflow streak. The flows are followed as a gauge of institutional participation in crypto through traditional brokerage accounts — one of the drivers, alongside real yields and dollar liquidity, that CoinShares' Butterfill cited above as carrying more weight than elections for Bitcoin.
Saylor's STRC (live tracker) hit its $100 par value yesterday for the first time since May, enabling Strategy to buy 191 BTC. STRC is Strategy's preferred stock, whose proceeds the company uses to buy bitcoin.

- A Polygon Labs validator support team member proposed a hard fork of Polygon PoS to move roughly 70.49 million POL — stolen in the Polymarket and Binance hacks and worth about $6.5 million — from the attackers' addresses to recovery addresses designated by both companies, as reported by WuBlockchain. A hard fork only takes effect if the network's validators and node operators adopt the new rules, so the proposal would need broad consensus before any funds move.
