米上院、未解決の対立を受けCLARITY法案の採決を9月に延期

米上院は、8月の休会前に合意に至らなかったことを受け、CLARITY法案の採決を9月に正式に延期した。SECとCFTCの間でデジタル資産に対する規制権限の線引きを明確にすることを目指すこの暗号資産市場構造法案は、超党派の支持を維持しているものの、いくつかの未解決 საკითხがあったため、上院指導部は今週これを前進させることができなかった。今回の延期により、規制当局、銀行、暗号資産企業が強い関心を寄せてきた立法作業がさらに長引くことになる。これらの関係者はいずれも、デジタル資産市場に対する連邦監督が最終的にどのように定義されるかに利害を有している。

採決を妨げている主な障害

Politicoによると、上院が休会に入る準備を進める中、議員らは複数の重要論点で膠着状態にあった。

最大の障害は、Thom Tillis上院議員とRuben Gallego上院議員が主導する超党派の倫理提案だ。Foxのジャーナリスト、Eleanor Terrett氏は、数日にわたる協議を経てホワイトハウスがこの提案への関与を始めたと報じたが、協議はなお継続している。

同時に、ホワイトハウスが法執行当局から提起された懸念への対応を進めるなか、上院議員らはBank Regulatory Clarity Act（BRCA）をめぐる協議にも取り組んでいる。

もう一つの大きな争点は、ステーブルコインの利回り規制だ。最近のWall Street Journalの論説をきっかけに利回り付きステーブルコインをめぐる議論が再燃し、より多くの上院議員が法案修正を求めていると報じられている。この問題は、決済用ステーブルコインの連邦枠組みを整備したものの、利回り付きの類型についてはなお結論が固まっていないGENIUS Act成立後に、より重要性を増した広範な政策課題に関わっている。

上院指導部はまた、十分な支持を確保できないまま本会議に付した場合、終結動議が否決され、数か月にわたる超党派協議が損なわれる可能性を懸念していた。

今後の3つのシナリオ

現在、議会は休会中であり、CLARITY法案の行方は3つの方向に進む可能性がある。

第1のシナリオは、8月を通じて協議を継続し、上院が9月に再開される前にホワイトハウスと議会指導部が合意を固めるというものだ。

第2の可能性は、上院議員が倫理規定、ステーブルコインの利回り、BRCA関連事項を含む修正版の法案文言を持ち帰り、別の手続き採決を行う前に再調整することだ。

第3のシナリオは、さらなる延期である。議会は多忙な立法日程と選挙運動が重なる中で再招集されるため、未解決の論点が残ったままでは、本法案が本会議の時間を確保するのは難しくなる可能性がある。

業界は引き続きワシントンに圧力

CoinbaseのBrian Armstrong CEOは、上院がCLARITY法案にほぼ1年取り組んできたと述べ、上院議員、規制当局、銀行、暗号資産業界がいずれも妥協を重ねてきたと指摘した。
